1.) Scope and offer

JP KREIS offers coaching and short-term counseling for executives, private individuals and athletes (=customers). The General Terms and Conditions – GTC for short – apply to the business activities of JP KREIS with its customers – clients – and for the entire duration of the cooperation. By booking an online coaching session, customers accept these terms and conditions – click-to-accept button. JP KREIS and her coach work according to the guidelines and professional code of conduct of the bso and ZiS – Berufsverband für Coaching, Supervision und Organisationsberatung bso / Zentrum für interdisziplinäre Systemtherapie, ZiS.

2.) Duty of cooperation of the customer – client

Coaching is based on cooperation and mutual trust. Coaching is a free, active and self-responsible process. JP KREIS assists clients as a process facilitator and supporter in decisions and changes. Clients are responsible for the content of coaching sessions. The actual change work is done by the client. They should therefore be willing and open to dealing with themselves and their situation.

3.) Order clarification

The order for coaching is placed by booking a selected service via the website www.jpkreis.ch. In an initial meeting – which can only be booked online for a fee – JP KREIS clarifies the client’s concerns, needs, goals, expectations, framework conditions and whether further collaboration is suitable. If the customer requests a service that cannot be booked via the website – e.g. workshop, team coaching, on-site conflict moderation – JP KREIS will set out the framework conditions including fees and expenses, participants, objectives and content as well as other contractual provisions in a separate agreement.

4.) Prices and booking process

The online coaching sessions that can be booked on the website www.jpkreis.ch are subject to a fixed price. JP KREIS may change the prices at any time. When making a booking, the price of the selected service published on the website shall apply. Prices are quoted in Swiss francs. Invoices must also be paid in this currency. VAT is currently not charged and therefore not shown, as JP KREIS is not subject to VAT. Customers pay the invoices/coaching in advance via the website. The possible means of payment are listed on the website. After booking, customers receive the booking and payment confirmation and the meeting link by email.

5.) Cancellation by customers – clients

Cancellation of the booked appointment is possible up to 24 hours before the appointment via the booking tool, for Monday appointments until 12.00 noon on Friday. If the cancellation is made up to 24 hours before the appointment or by 12.00 noon on Friday, the customer – client will receive a full refund of the amount paid. If the cancellation is made within 24 hours before the appointment or after 12.00 noon on Friday, there is no entitlement to a refund of the amount paid.

6.) Appointment rebooking by customers – clients

Coaching sessions can be rebooked up to 24 hours before the appointment via the booking tool, for Monday appointments until 12.00 noon on Friday. A rebooking within 24 hours before the appointment or after 12.00 noon on Friday will be treated as a cancellation.

7.) Appointment rebooking by JP KREIS

JP KREIS reserves the right to cancel coaching sessions by e-mail at any time for reasons of force majeure, objective impossibility or health reasons without incurring any costs. A new date will be sought together.

8.) Confidentiality

JP KREIS and its coach undertake to maintain unlimited confidentiality vis-à-vis third parties regarding all operational, business and private matters of the customer – client that become known in the course of the activity, even after the termination of the contract.

JP KREIS and its coach are subject to a duty of confidentiality. However, JP KREIS reserves the right to waive the duty of confidentiality if a risk of personal injury or injury to third parties becomes apparent. In this case, JP KREIS and her coach will contact a professional body.

9.) Internet connection and technical faults

Online coaching requires a stable internet connection and appropriate equipment – good speakers, a good microphone and a good camera. JP KREIS assumes that customers have stable internet, appropriate equipment and know-how in dealing with video conferencing. Should technical problems nevertheless occur, JP KREIS will continue the coaching by telephone or with another video tool.

10.) Copyright, terms of use

JP KREIS retains the copyright to all documents, concepts, drafts and other materials created by JP KREIS as part of the service. All material in any form created by JP KREIS as part of an order or provided to the customer as part of the provision of the service may in any case only be reproduced, published or made publicly accessible with the express written consent of JP KREIS. In particular, it may not be used for similar services, revised, rewritten or modified or adapted in any other way

11.) Liability and insurance cover

The activity of JP KREIS is purely a service activity. Success is neither guaranteed nor owed. Any liability is excluded. All customers are insured privately or by their employers. They are not covered by JP KREIS insurance. The coaching sessions do not replace visits to the doctor or prescribed medication and therapies. The dispatch or electronic transmission of any data is at the customer’s – client’s – own risk.

12.) Reference

JP KREIS may use clients – companies – as references. This also includes the publication of the client’s logo on the JP KREIS homepage.

13.) Complaints and legal action

Clients can submit complaints to the bso ombudsman’s office, which acts in an advisory or mediating role. The right to take legal action remains reserved. The exclusive place of jurisdiction is Bern. Swiss law applies.

14.) Final provision

Should individual provisions of the contract with the customer – client, including these GTC, be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. The wholly or partially invalid provision shall be replaced by a provision whose economic success comes as close as possible to that of the invalid provision.
